Over the weekend I did some research to make sure I am up to date with all the current U.S. state and U.S. territories breach notice laws…
There are currently 47 such laws; see a 1-page listing of them here.
I created this as a quick reference to see the states, regulation number, and effective date all on one page.
I want to also make hyperlinks to the actual regulatory text from the regulation numbers, but I just need to make some time to do that; hopefully after I get taxes done.
I know there are several other lists of these laws out there, but the ones I’ve found are either not up-to-dat and/or have more information than I want to be able to see at a quick glance. Sometimes simplicity is best and/or preferred.
FYI, here are the 6 states with no breach notice laws:
- Alabama: Whatever happened to SB489? Wonder why this never got to the governor’s office and signed?
- Kentucky
- Mississippi
- Missouri
- New Mexico
- South Dakota
These are no longer the ONLY U.S. breach notice laws. Keep in mind that now, under the expansion of HIPAA under the HITECH Act, any healthcare covered entity (CE) and business associate (BA) must also provide breach response and notice activities for protected health information (PHI).
