France Performing Audits To Check For Spam

While doing some research on data protection laws in France, I found it interesting to learn that this past September the French data protection authority (CNIL) stared auditing businesses to check for unlawful spam operations.


The audits are part of CNIL’s partnership with Signal Spam, an anti-spam coalition. Every month, Signal Spam provides the CNIL with a list of companies and other organizations for which it has received spam complaints from Internet users.
Two French laws apply to spam: the Law on Information Technologies and Freedoms, Law No. 78-17, and Art. L. 34-5 of the code on electronic posts and communications, Law No. 2004-575.
These laws require all users to “opt in” to receive promotional emails, otherwise they are breaking these laws.
